During your contact with Vanheede, you may share personal data with us so that we can identify you as an individual, employee of a company, etc. (For example, your full name, email address, address, and phone number). This is your "personal data".
2. What personal data do we process and for what purposes?
Vanheede collects, registers and processes personal data of contact persons at Vanheede's (potential) clients (hereinafter referred to as 'Client(s)'), candidates, employees, self-employed freelancers or other persons with whom our company has contact. For example, data is communicated by people themselves when contacting.
Personal data is always processed in accordance with the principles of privacy legislation and the General Data Protection Regulation, i.e. European Regulation 2016/679 of 27 April 2016 on the protection of personal data.
The personal data is processed in a lawful, proper and transparent manner and for a specific and explicit purpose. Through regular updates of our database, Vanheede also ensures data minimisation.
Vanheede processes your personal data for the following purposes, among others:
- Customer management - the collection of new prospects, contact persons, company data, identification data, financial data, information and project information exchange;
- Recruitment of new employees – professional contact details, position, experience career data;
- Information about our professional and social activities, or any other subject that may concern you through our communication channels (p.e. newsletter, website);
- When you contact our company via social media or your profile is accessible within these platforms, personal data may be shared with Vanheede as part of that platform, we advise users of social media to check the privacy conditions as a user of such platforms.
- For the further execution of agreements entered into with our customers and execution of our services - customized waste management,;
- Handling financial and accounting obligations;
- Data analysis to improve the efficiency and performance of our services, for which AI models can be used. AI systems can be used to deliver our services to the Customers even faster. For these AI systems, we use a risk-based approach in accordance with the applicable legislation.
- To comply with other legal obligations, for example, environmental legislation;
- When the legitimate interest of the company requires it, but this is always clear to the data subject, for example in the case of security considerations.
- Cameras are used on our sites. The aim is to guarantee the safety and proper functioning of our flows. These images are deleted after 30 days, unless there is a finding.
Other data is collected by automated means by 'cookies' and other systems/applications that collect information when visiting the website. When you visit the website for the first time, you can use our cookie pop-up to set the types of cookies to your liking and find more information about the relevant cookies.
The personal data is protected in an appropriate way by means of appropriate technical and organizational measures that we prefer not to disclose, if you have more questions about this, please contact our DPO.
Vanheede as a waste processor
In the services provided by Vanheede, Vanheede often processes waste on behalf of the Client.
Vanheede performs its services in the manner agreed with the Client concerned. Vanheede is not responsible for the way in which any waste containing personal data is processed, unless explicitly agreed otherwise.
If any questions arise about this, you will be referred to the Responsible Customer about the processing and deletion of your personal data.
3. With whom do we share our personal data?
Vanheede opts for partners who can guarantee the same level of protection for your personal data. The personal data will not be transferred outside the European Economic Area (EEA) unless sufficient safeguards are provided in accordance with the General Data Protection Regulation or the EU-U.S. Data Privacy Framework.
Your personal data may be shared with external business partners. For example, suppliers of IT infrastructure, administration or accounting obligations, but also subcontractors or sub-processors.
4. How long do we keep personal data?
The retention period of the personal data is limited to as long as necessary with regard to the realization of the purposes of the processing. In doing so, we strive for an up-to-date database with regular updates.
For agreements with the Customers, the retention period depends on the duration of the agreement and the associated legal obligations in the performance of the services to the Customer. If you would like more information about this, please contact our privacy team.
With regard to candidates, the following term has been agreed:
• Not retained candidates: 2 years without permission, 5 years with permission
With regard to persons who had a contractual relationship with Vanheede:
• The personal data is kept for 10 years after the end of the last employment contract with the person, due to possible commercial claims and accidents at work. However, this period can be deviated from in exceptional cases such as a long-running dispute.
5. Rights of the data subject
You have various rights with regard to the data that we process about you. If you wish to invoke any of the following rights, please contact our privacy team.
Right of access and copy
You have the right to view your data and to receive a copy of it. This right also includes the possibility to request further information about the processing of your data,
including the categories of data that are processed about you and for what purposes this is done.
Right to rectification
You have the right to have your data changed if you believe that we have incorrect data.
Right to erasure (right to be forgotten)
You have the right to request that we erase your data without undue delay. However, we will not always be able to comply with such a request, for example if we still need the data in function of an ongoing membership or file, or if the retention of some of your data for a specific period of time is required by law.
Right to restriction of processing
You have the right to restrict the processing of your data. In this way, the processing is temporarily stopped until, for example, there is certainty about its accuracy.
Right to withdraw your consent
If the processing is based on your consent, you have the right to withdraw this consent at any time by contacting us.
Right to object
You have the right to object to the processing of your data that is based on our legitimate interests or the public interest. This should be done on the basis of specific reasons related to your situation. In this case, we must stop the processing, unless we can demonstrate compelling legitimate grounds to continue the processing.
However, you can always object to the use of your data for direct marketing purposes, after which we are in any case obliged to stop processing for these purposes. For promotional communications that you receive from us by e-mail, you can easily exercise this right to object by clicking on the "unsubscribe" button provided.
Right to portability
You have the right to obtain your data that you have provided to us yourself with your consent or in execution of an agreement, in electronic form. In this way, they can easily be transferred to another organization.
Right to lodge a complaint with your supervisory authority
If you believe that we are processing your data in an incorrect manner, you always have the right to lodge a complaint with your data protection supervisory authority. You can do this with the supervisory authority of the EEA Member State where you habitually reside, have your place of work or where the alleged infringement was committed. As a Belgian company, we refer below to the contact details of the Belgian Data Protection Authority.

Security and confidentiality
Vanheede has developed security measures, adapted from a technical and organisational point of view, to prevent the destruction, loss, falsification, alteration, unauthorised access or accidental disclosure to third parties of personal data collected on the website, as well as any other unauthorised processing of this data.
Our website and/or service does not intend to collect data about website visitors who are under the age of 16 unless they have permission from parents or guardians.

Accuracy of your data
Any person who communicates data to Vanheede guarantees that this data is accurate and complete. The communication of incorrect data or data belonging to third parties may result in the person being denied, temporarily or permanently, any access, in whole or in part, to Vanheede's products and services.
Provisions relating to the website
Vanheede Environment Group cannot be held responsible for any inaccuracies or shortcomings in the information contained on the site. This applies both to information placed on the site by Vanheede Environment Group itself, as well as to information provided by users (visitors and advertisers).
Incorrect data or shortcomings on the Vanheede Environment Group site do not entitle you to financial compensation. Vanheede Environment Group is not responsible to users or third parties for any direct, indirect, incidental damage, loss of profit or for any damage caused by its negligence or omission in providing, compiling, assembling, writing and interpreting information. In any case, as a user, you agree that Vanheede Environment Group will not be held liable in the event of Force Majeure. Force majeure includes: Hacking, Pandemic, Cyber war, War, natural disasters, failure of the electricity grid, ...
Vanheede Environment Group explicitly offers the website "as is". The most advanced techniques are used for its technical realization. However, Vanheede Environment Group cannot be held liable for the (temporary) failure or possible malfunctioning of the system.
Vanheede Environment Group is not responsible for links to sites managed by third parties. Vanheede Environment Group does not exercise any control over the aforementioned websites and accepts no liability whatsoever with regard to their content. The information on the site is changed periodically. Vanheede Environment Group reserves the right to make improvements and/or changes to the site at any time.
Intellectual property and copyright
The user expressly acknowledges that the data provided on the site (texts, graphics, etc.) are and remain the property of Vanheede Environment Group. No part of the site may be used for reproduction, adaptation, distribution, sale, publication or commercial purposes without the prior written consent of Vanheede Environment Group. It is also forbidden to store, scrape or use this information electronically for purposes not approved by Vanheede Environment Group or for unlawful purposes. Other provisions
This Privacy Policy may be amended from time to time, taking into account, among other things, new laws and regulations or evolutions in this regard. The changes will take effect automatically upon publication. If one of the previous provisions on the processing of personal data or any other provision is not valid, all parties agree that it will be replaced by a provision that will approximate the underlying purpose of the proposed provision as much as possible.
Vanheede's Privacy Policy is subject to Belgian law.
The Belgian Authorities (e.g. the Data Protection Authority) and the courts competent for the registered office are, to the exclusion of all others, competent to hear disputes and complaints that may arise in relation to this website or its use or in relation to the processing of personal data or any other dispute.
